Types of Lawyers: "Commercial Law" Through "Environmental Law".

Commercial law . The types of lawyers that practice Commercial law work with the laws of business; starting a business, issues with running a business, buying/selling a business, loans, contracts, negotiations and other commercial transactions related to same. The types of lawyers who practice in this legal profession should be knowledgeable in the uniform commercial code, contract law, consumer law, bankruptcy, agency, corporate law, tax law, and leasing.

Constitutional law . Constitutional law concerns the fundamental rights of the government and individuals as originating from the U.S. Constitution. Fundamental rights defined as; equal protection claims (discrimination), right to bear arms, religious freedom, and speech. It is very rare in the day-to-day business of practicing law to come across constitutional issues, in fact the majority of attorneys will never deal with constitutional issues at any point in their career. It is also important to note that there are very few attorneys in the United States who practice in this field, and the types of lawyers who do practice in this legal profession do exclusively research and litigation (no transactional) type of work.

Consumer Law . This form of laws concerns the personal and family transactions in a given marketplace. The intended goal of the government in enacting such laws is to protect the consumer from questionable business practices and outright fraud, and instill confidence in the overall market. This form of law concerns all interactions between commercial sellers and all types of buyers. The lawyers who practice in this legal profession will often work on claims regarding false advertising, bait & switch, pyramid schemes, and other fraud.

Construction law . Construction law covers all aspects of building and construction. The lawyers who practice in this legal profession will be familiar with a wide range of legal issues including contract law, bidding processes, bonds and bonding, guarantees and sureties, liens, security interests, and related accident and contract dispute litigation.

Corporate law . The practice of corporate law concerns the powers, duties, responsibilities of corporations and how to properly authorize action under the corporation’s documents. The types of lawyers who practice in this legal profession will assist corporations in how to run the corporation, and the duties that officers of corporations owe to the corporation and investors. A corporate lawyer will have knowledge in securities law, bankruptcy, general corporate operations, Mergers & Acquisitions. Some lawyers are actually employees of the corporations themselves, otherwise known as “in house” attorneys. Responsibilities include assisting the company’s management run the business smoothly and avoiding any legal problems by approving certain corporate actions and disallowing others.

Education law . Education law concerns governing educational bodies and school systems. Further it concerns the powers of schools, student’s rights and student movements, and special needs programs. This is exclusively governed by state law and thus every state has different rules, regulations, and interpretations.

Entertainment Law . Entertainment law concerns TV, radio, music, theater, films, as well as other entertainment vehicles. The most valuable commodities in entertainment law are not physical but in fact intangible, that is why a fundamental part of entertainment law is intellectual property law (which will be discussed on a subsequent page), but this field generally concerns the rights of copyright, trademark, licensing, and other agreements. This form of law is designed to protect the creators who create intangible entertainment and intellectually property and to make sure the owners of the rights get paid. The types of lawyers who practice in this legal profession require knowledge of contract law, labor law, and privacy law.

Environmental law . Environmental law concerns statutes, regulations, and common law that operate to regulate human activity and the natural environment. Both federal and state laws apply: federal government enforcement of environmental laws through the Environmental Protection Agency, and the states through their own agencies. General environmental law focuses on clean water, clean air, remediating contaminated sites, and regulation of industry that produces toxic chemicals. The types of lawyers who practice in this legal profession mainly exist in the litigation realm.
